Abstract

This article aims to analyze the judicialization of the Brazilian public health system. To achieve this purpose, it intends to: a) demonstrate the growing trend of lawsuits related to health in Brazil; b) highlight the significant budgetary and financial disorganization that public entities face due to court orders that require the provision of medications; c) analyze the jurisprudence of the Supreme Federal Court. From a methodological standpoint, descriptive research was developed, with the main sources being the Brazilian Constitution, the norms of the Unified Health System, and the doctrine produced by jurists from different countries. Finally, considerations are presented, with the intention of contributing to a coherent interpretation of the Brazilian constitutional order, which gives efficacy and effectiveness to the constitutional norm that guarantees the right to health.
